Workers Compensation
Workers’ Compensation is a statutory method of providing benefits to an employee (or the employee’s dependent) who suffers a personal injury or death by accident or occupational disease arising out of and in the course of employment. The concept of fault and consequently negligence is not usually present.
When an employee is injured in an accident on the job and is out of work for a period of time, workers’ compensation should cover the costs of recovery, medical fees, rehabilitation expenses, vocational rehabilitation or retraining, and other medical expenses. The needs of a family do not end just because an employee can not return to work. Workers’ compensation laws were enacted to aid employees and families in a timely, efficient manner after a workplace accident. New Jersey provides wage benefits based upon a percentage of the claimant’s weekly wage, subject to a minimum and a ceiling as determined annually by the Commissioner of Labor.
After discharge from active medical or therapeutic treatment, or upon the claimant’s return to work, temporary total disability is discontinued and the employer or its insurance carrier is required to pay partial permanent disability or total permanent disability. If the injury or occupational disease results in the death of the employee, his or her dependents may bring an action for dependency benefits.
